Charged 2018 World Junior players elect trial by jury

Five former members of Canada’s 2018 World Junior hockey team who have been charged with sexual assault have elected to have a trial by jury, their lawyers said.

“Earlier this week, all five players selected a trial by jury, and they are confident that jurors drawn from the community will decide this case fairly and impartially after hearing all the evidence and testimony,” lawyers representing the accused players wrote in a joint statement to TSN.

The Globe and Mail first reported on the lawyers' statement earlier today. The players' request to be tried together was granted during a court appearance Tuesday in London, Ont., according to the Globe.

Criminal lawyers not involved in the case have been divided about whether a trial by judge or jury would be more advantageous for the players. 

A trial date in the case probably won't be set until at least this spring.

They just put a child rapist back on the street because his case exceeded 18 months. Over simplification but there it is.

Particularly those who have money and influence. There is a reason why wealthy people are historically far less likely to face punishment. The entire system is fucked.

not sure how we restrict access to better lawyers... 

 

I had a neighbour who ended up as a crown prosecutor in Ontario. It sounded like the day to day work was an absolute shit show, with almost no time per case when public defenders were involved. Peoples lives being decided in a few minutes. 

 

Not sure what the answer is but I'd be happy to see reform for sure.

It seems to me that one of the problems is that Judges and lawyers for that matter, keep on stretching the law.

 

Law used to be very black and white, but today, it is  more like domino's, where judges give exceptions to the exceptions, and so forth.

 

Then, 50 years later, the new law is 180 degree's away from the old law. (maybe not that much, but you get the point!)

 

I mean, "IF" you are planning to shoot the President of the USA, how many arguments can you use, about the assailant's past

 

I mean, what does it matter?  Same goes for the length of the sentence, that is lessened, because his daddy spanked him. ??????

 

All this goes to lengthen court cases, increases court and lawyer costs......it is ridiculous!

It sounded like there were just too many cases and too few staff to handle it all, but you could be right about the length of individual cases.

I think there is far too much posturing..........

 

Tell a sad story how the guy was beaten as a kid, how he did not really understand his actions, cry a little..well that takes days to introduce all those witnesses, then point out he could not do anything to help himself................Bizzare! Is what it is...........

 

Just like the guy that hacked the head off a fellow passenger............he is out now.........incredible.........why is he out?   Cut and dry...................plug him in to 440 and not have to take anyone else's time up

Legal Proceedings take a lot of time. It took almost 2 years to find Harvey Weinstein guilty after being charged for his crimes.

I can see the concern here being Section 11(b) of the Constitution, which was the reason why R v Jordan resulted in a stay of proceedings.  The last thing that anyone wants in a situation like this is for justice to be denied because of the technicality that "the clock ran out".  Well, anyone except perhaps those who would otherwise have been found guilty.
